Article 6 Equality of rights and duties
This article is divided into three subsections:
Paragraph 1. This item addresses two issues: all students have the same rights and duties;and the necessary resources for the guidance of students. (Orientation department).
Currently the vast majority of Andalusian compulsory school age children attend school, regardless of their social class or economic resources. The question to ask here is the conditions offered by the centres, not all public and funded subsided schools are equipped with an orientation area. This area is important, since as teachers if we see any strange behavior in some students, together with their parents and this Department we can solve any problem that the student have and we can provide it with support.
Paragraph 2. This is simple, talks about the right of students to understand the principles of the Constitution and statute of autonomy.
In our view, this paragraph is not fulfilled. Students have the right to know this article, but if it is not taught almost nothing of the Constitution in schools and to know something about the Statute of autonomy, you must enroll in law degree. In addition, if teachers not explained to children the Constitution and the Statute of autonomy , by their own , they are not going to have an interest in this topic.
Paragraph 3. Here, talks about the follow-up administration that schools comply with the rights and duties of students.
Andalusian schools have an annual inspection. In practice they comply with the legislated in this section of the article but we don´t know the quality as theirs already do it, is different.
Article 39 Education in Values
This article is divided into 4 sections:
Paragraph 1. Importance of human rights and fundamental freedoms in the teaching activities. (see art.27 CE, related to education).
Article 14 EC says that the Spaniards are equal before the law, without discrimination of race, sex, religion or opinion, but this article is not fulfilled in practice, we can extrapolate these values to the school, promoting non-discrimination, to eliminate problems of bullying in the classroom, here it is true that many schools are doing awareness and are promoting this type of values.
Paragraph 2. Effective equality between men and women across the curriculum.
There should be no inequality between men and women in the workplace, but it is true that many private schools they prefer to hire male teachers before female teachers, with respect to the public system, go by oppositions so results will acquire by places in schools.
Paragraph 3. The curriculum should promote equality and acquisition of healthy habits.
This section if it is quite noticeable in all schools, since they can not smoke in them when a few years ago if that could be. To many schools, nutritionists will give talks on healthy habits and gradually will be implementing more physical activity in the classroom.
Paragraph 4. The curriculum will include various factors useful for daily life such as driver education, respect for multiculturalism, diversity, the environment, etc. In this section, we think that it depends on the College will have some plans or others, or will give more importance to some topics than others. But in general, we believe that they are fulfilled in schools, many schools work especially the issue of the environment with the children doing murals, they used to work these issues through a pleasant way to raise them awareness.
